Debt Suit | Weatherford Attorney | James Foley PLLC
Has someone come to your house and handed you what appears to be legal paperwork? Look for the term citation. Look for words like you’ve been sued, and you have the right to hire an attorney. Maybe it was a uniformed deputy in a marked car but more likely it was a private process server in civilian clothes and their own private vehicle.
Maybe you haven’t been served yet but you are getting solicitation letters from my competitors offering to either defend you on the suit or to help you file bankruptcy. I am well versed in both debt defense and bankruptcy.
I’m James Foley, PLLC. Call me and I can discuss the following with you, or you can read through yourself and then phone me at 817-738-1633. If you’re concerned about the prospect of jail time, it’s very rare, and I’ll work to resolve the issue.
Take the following steps, and call me as soon as you’ve reviewed the following:
1. Immediately address the court summons, notice, or any contact that you’ve received.
Clients in Arlington, Weatherford, and Mineral Wells have taken their fates into their own hands, and you should too. The time is now to act. Do not hesitate. You’ll feel better knowing you’re set on the right path.
Many cases will only give you 14 days to reply, otherwise they’ll deem you guilty. Don’t let this happen. Responding in a given amount of time will be the best favor you can do for yourself.
2. Is the summons legitimate?
Under Texas law if you do not answer a lawsuit the Court will grant the other side a default judgment. You cannot ignore a lawsuit just because you think it’s crap. It is incumbent on you to answer the law suit, hold the other side to their burden of proof, serve discovery, etc. The Court is not going to do your homework for you.
3. This isn’t Monopoly. “Bankruptcy” isn’t a bad word!
If you alone, or with my help, determine that a more lenient payment plan won’t work for your financial situation, that’s where we’ll talk about bankruptcy.
Bankruptcy is a fairly straightforward process, and helps consumers every year in ways they’d never think imaginable. I’ve guided multiple clients from Grand Prairie, Arlington, Haltom City, White Settlement, Granbury, Weatherford, Aledo, and Azle through this process. As long as you’re considering bankruptcy in Texas, I’m in your corner. We’ll sit down in person at my Fort Worth office, or virtually (thanks to social distancing), and talk about your options, namely chapter 13 and chapter 7.
Whether it’s vehicle repossessions suits or loan deficiency suits, we’ll get down to business on your creditor situation and determine the best path for both you and your lenders.
The Finish Line in Sight
Chapter 7 bankruptcy allows you to keep most assets, including your home, and provides a clean avenue toward financial forgiveness, and a clean start. I hope when you think back on reviewing this site, you’ll remember it as the beginning of the end to all your problems.
So whether you’re looking to discuss bankruptcy options in Weatherford, Aledo, or Fort Worth, call me today at 817-738-1633, and let’s take action today.
