Most consumers don’t realize these are two separate entities, but they are in most senses. 

We hear so often about our credit score, but that score is calculated in relation to our credit reports. Checking your credit score is only a symptom, whereas keeping tabs on your credit report will help to keep your finances healthy.

What kinds of things am I talking about?

The kinds of inaccuracies that I work on and often litigate include inaccuarate or often outdated public records (like judgments); credit reports showing inaccurate information after litigation, such as a take nothing judgment for the debtor on a collection suit, stale, outdated, or reaged debt.  The statute of limitations is 7 ½ years from the date of first delinquency. HOW TO GET STARTED

Go to www.annualcreditreport.com to check your report, and input the requested data. 

You’re able to perform this check every year, or three times a year if you separate checks from each reporting agency. Do whichever you’ll be able to keep track of, as fraud can appear on any one of the three, and not the others, in some cases. 

FIND SOMETHING ERRONEOUS? 

You may be entitlted to monetary dameges if you’ve found a fraudulent or incorrect item. 

The error you’ve found may have resulted in a lower credit score at some point in the recent past. You now have a chance to improve your credit score by fixing your credit report, not to potential money damages. 

Who wouldn’t be interested in that? 

There are many possible reasons to lose points on your credit score, but if for some reason you’ve maintained a consistent series of accounts, this shouldn’t happen. My name is James Foley PLLC, and I’m here to protect you from fraud and illegal activity by companies who try to steal from you. 

The Dispute Process

Under the Fair Credit Reporting Act Liability attaches only after a dispute has been initiated. The dispute must be sent to the bureaus. They will then forward that information to the furnisher (the creditor providing the information), and then both entities are required to investigate the dispute. The dispute should include enough information to identify the consumer, and the account or tradeline in question. The dispute letter and accompanying documentation should spell out exactly why the information is incorrect and why you are disputing it. It should be clear on the face of the narrative and your included documents why the disputed information is wrong. 

I like to draft the disputes myself, and on my letterhead. I also send the letters by certified mail, return receipt requested. There are other methods to disoute, but this way leaves a definite paper trail. Sometimes it solves the problems, other times it sets up a lawsuit.

With only one month at their disposal, a fraudster can affect your future ability to buy a house, a car, or get a loan. This is not to mention an account that stays that way for months or years. Catch the issue before it gets worse. 

Even when you catch an issue, the statute of limitations is only two years, so your time to fix the problem is rapidly expiring from the moment you realize what’s happened.
