When someone passes away, the probate process is initiated to distribute the assets of their estate according to the will or the laws of intestacy. When there is a valid will the executor named in the will, through their attorney, will ask for a hearing. At this hearing the executor ask the Judge to grant letters testamentary. This is a court order that grants the executor the authority to distribute the assets of the person who has recently passed away, and conduct the affairs of the estate. This can include locating and distributing assets, notifying beneficiaries, and sending proper notice to potential creditors. Sometimes these matters may have a special urgency as bills, and expenses relating to last illness and/or the funeral need to be paid.
